    HE WAS HURT IN A FOUR WHEELING ACCIDENT WHILE RIDING IN A CHARITY A-T-V RUN NEAR WEBSTER SPRINGS ON SATURDAY.

    JIVIDEN WAS AN ORGAN DONOR.

    HIS ORGAN DONATION COULD SAVE THE LIVES OF UP TO EIGHT PEOPLE.... AND HELP MANY OTHERS...

    LABOR LEADERS SAY KEY ISSUES THIS YEAR IN WEST VIRGINIA WILL BE THE MINE WORKERS FIGHT OVER BENEFITS SLASHED AROUND THE PATRIOT COAL BANKRUPTCY AND A NEW CONTRACT BETWEEN THE C-W-A UNION TELEPHONE WORKERS AND FRONTIER.

    THERE WERE PLENTY OF POLITICIANS COURTING THE UNION VOTE--EVEN IN AN OFF YEAR FOR ELECTIONS. THE 2014 PRIMARY WILL BE OVER BEFORE THE NEXT PICNIC.

    THERE IS NOW JUST MORE THAN 14 MILLION UNION WORKERS IN AMERICA-- DOWN FROM THE PAST--THAT MAKES UP MORE THAN 11 PERCENT OF U-S WORKERS.

    OVER IN MARMET... DOZENS OF PEOPLE CAME OUT TO WATCH THE CITY'S ANNUAL LABOR DAY PARADE.

    THIS AFTERNOON, THE SECRETARIES OF STATE AND DEFENSE ALONG WITH THE CHAIRMAN OF THE JOINT CHIEFS OF STAFF WILL TESTIFY AT A HEARING ON AUTHORIZING USE OF FORCE IN SYRIA.

    ABC'S TAHMAN BRADLEY IS IN WASHINGTON WITH THE LATEST.

    Before departing tonight for Sweden, President Obama will push members of

    Congress to back military action in Syria.

    The President has invited a number of lawmakers -- including House Speaker

    John Boehner and Democratic leader Nancy Pelosi -- over to the White House

    this morning for candid talk.

    Mr. Obama appears to have already won tentative support from two Republican

    Senators, Lindsey Graham and John McCain.

    "I THINK WE HAVE FOUND SOME AREAS WE CAN WORK TOGETHER. BUT WE HAVE A LONG

    WAY TO GO."

    McCain says he isn't sure a vote authorizing a military strike on Syria

    would pass.

    "I REALLY HAVE NO IDEA BECAUSE I THINK A LOT OF PEOPLE HAVE NOT MADE UP

    THEIR MINDS."

    Some lawmakers who've received a classified briefing on Syria by the

    President's national security team remain skeptical.

    "I DON'T SEE WHERE THE ASSAD REGIME POSES A DIRECT THREAT TO AMERICA OR ITS

    ALLIES."

    Others think the U.S. should take action against Bashar al Assad's regime,

    but need further explanation about the President's call for a limited strike.

    "WHAT'S MISSING RIGHT NOW IS THE PLAN OF ACTION ABOUT WHAT WILL HAPPEN IN

    THE EVENT THAT THE UNITED STATES DID USE SOME TYPE OF FORCE AGAINST SYRIA."

    In Syria, rebels battling the Assad regime are furious that President Obama

    delayed military action so that Congress can vote.

    The rebels sought to exploit strong emotions.

    These kids held signs urging a U.S. intervention. "Save the children of

    Syria," one said.


    The United Nations refugee agency says more than two-Million refugees have

    fled Syria's violence. The country is losing almost 5,000 citizens a day.

    MANCHIN SAYS AUTHORIZING THE USE OF U-S MILITARY FORCE AND WEAPONS IS ONE OF THE MOST DIFFICULT DECISIONS A COUNTRY CAN MAKE AND ISN'T SURE WE SHOULD PROCEED WITH A STRIKE IN SYRIA. BUT REPRESENTATIVE NICK RAHALL SEEMS MORE AGREEABLE TO AN ATTACK.

    "I haven't seen a thing that tells me we need to vote to go in there. There's nothing coming out from the standpoint we've got Hezbollah on one side. We have Al Qaeda on the other. We don't have a friend to be had. There's no immediate threat to the United States of America.

    "Assad's use of chemical weapons cannot be tolerated. It is reprehensible. He needs to be condemned in the strongest words, and I do that. I think our response should take into account America's national security interests, and that's to ensure chemical warfare, weapons of mass destruction, do not get in the wrong peopl's hands. I want to give the president the benefit of the doubt because I think certainly a response needs to be made.

    MANCHIN WILL ATTEND SEVERAL DEFENSE-REALTED COMMITTEE BRIEFINGS TO ENSURE HE HAS ALL THE INFORMATION BEFORE THE SENATE BEGINS DEBATING SOMETIME THIS WEEK.

    RAHALL SAYS HE WILL TAKE PART IN THAT DEBATE-- AND THINKS CONGRESS SHOULD GET TO WORK QUICKLY.

    CONGRESSWOMAN SHELLEY MOORE CAPITO SAID ON FRIDAY THAT THE PRESIDENT WILL HAVE TO MAKE A STRONG CASE TO CONGRESS THAT ANY MILITARY STRIKE IN SYRIA IS JUSTIFIED AND IN THE BEST INTERESTS OF THE U-S. UNTIL THEN, SHE'S OPPOSED TO SUCH ACTIONS.

    WE ARE JUST DAYS AWAY FROM THIS YEAR'S GREAT CHARLESTON HEART WALK.

    THE MONEY RAISED WILL HELP HEART SURVIVORS OF ALL AGES GET BETTER TREATMENT AND INCREASE THEIR QUALITY OF LIFE.

    EYEWITNESS NEWS REPORTER DARRAH WILCOX INTRODUCES US TO ONE OF THOSE SURVIVORS.

    "You expect to take a healthy newborn home. We did not expect to.. we had a healthy normal pregnancy, so it was very shocking."

    Zachary Griffith had a pretty rough start to his little life.

    "We found out Zachary needed heart surgery when he was two days old."

    Shortly after birth, doctors found a valve condition that needed to be fixed immediately.

    "It was explained to us that his valve was closing, so the longer they waited, the more it would close. and eventually it would close so that no blood would be able to pump through his body."

    It was also heart-breaking for Zach's parents.

    "It's pretty tough to see your newborn hooked up to 20, 25 machines that are all vital to his survival."

    But Zach has proven his resiliency over and over. He's had two follow-up surgeries, one at nine months old and another at 18 months old.

    "Since he was 18 months old he's been doing very well. He gets check ups about every six months, and so far, so good."

    And he's the face for this year's Charleston heart walk this Saturday at the Capitol Complex. His family got involved with the American Heart Association when Zach was a toddler.

    "Kids and adults are living much longer with heart problems now because of the things that technology has given us and the heart walk has raised money for."

    They're sharing his story in hopes of raising money and awareness to help kids just like Zach. He'll need one more surgery to replace his aortic valve in the future, and his family hopes research will lead to even better technology by then. For now, Zach continues to be just like any other second grader.

    "We just take it one day at a time. One check up at a time."

    ABC'S TAHMAN BRADLEY IS IN WASHINGTON WITH THE LATEST.

    Before departing tonight for Sweden, President Obama will push members of

    Congress to back military action in Syria.

    The President has invited a number of lawmakers -- including House Speaker

    John Boehner and Democratic leader Nancy Pelosi -- over to the White House

    this morning for candid talk.

    Mr. Obama appears to have already won tentative support from two Republican

    Senators, Lindsey Graham and John McCain.

    "I THINK WE HAVE FOUND SOME AREAS WE CAN WORK TOGETHER. BUT WE HAVE A LONG

    WAY TO GO."

    McCain says he isn't sure a vote authorizing a military strike on Syria

    would pass.

    "I REALLY HAVE NO IDEA BECAUSE I THINK A LOT OF PEOPLE HAVE NOT MADE UP

    THEIR MINDS."

    Some lawmakers who've received a classified briefing on Syria by the

    President's national security team remain skeptical.

    "I DON'T SEE WHERE THE ASSAD REGIME POSES A DIRECT THREAT TO AMERICA OR ITS

    ALLIES."

    Others think the U.S. should take action against Bashar al Assad's regime,

    but need further explanation about the President's call for a limited strike.

    "WHAT'S MISSING RIGHT NOW IS THE PLAN OF ACTION ABOUT WHAT WILL HAPPEN IN

    THE EVENT THAT THE UNITED STATES DID USE SOME TYPE OF FORCE AGAINST SYRIA."

    In Syria, rebels battling the Assad regime are furious that President Obama

    delayed military action so that Congress can vote.

    The rebels sought to exploit strong emotions.

    These kids held signs urging a U.S. intervention. "Save the children of

    Syria," one said.


    The United Nations refugee agency says more than two-Million refugees have

    fled Syria's violence. The country is losing almost 5,000 citizens a day.

    MANCHIN SAYS AUTHORIZING THE USE OF U-S MILITARY FORCE AND WEAPONS IS ONE OF THE MOST DIFFICULT DECISIONS A COUNTRY CAN MAKE AND ISN'T SURE WE SHOULD PROCEED WITH A STRIKE IN SYRIA. BUT REPRESENTATIVE NICK RAHALL SEEMS MORE AGREEABLE TO AN ATTACK.

    "I haven't seen a thing that tells me we need to vote to go in there. There's nothing coming out from the standpoint we've got Hezbollah on one side. We have Al Qaeda on the other. We don't have a friend to be had. There's no immediate threat to the United States of America.

    "Assad's use of chemical weapons cannot be tolerated. It is reprehensible. He needs to be condemned in the strongest words, and I do that. I think our response should take into account America's national security interests, and that's to ensure chemical warfare, weapons of mass destruction, do not get in the wrong peopl's hands. I want to give the president the benefit of the doubt because I think certainly a response needs to be made.

    MANCHIN WILL ATTEND SEVERAL DEFENSE-REALTED COMMITTEE BRIEFINGS TO ENSURE HE HAS ALL THE INFORMATION BEFORE THE SENATE BEGINS DEBATING SOMETIME THIS WEEK.

    CONGRESSWOMAN SHELLEY MOORE CAPITO SAID ON FRIDAY THAT THE PRESIDENT WILL HAVE TO MAKE A STRONG CASE TO CONGRESS THAT ANY MILITARY STRIKE IN SYRIA IS JUSTIFIED AND IN THE BEST INTERESTS OF THE U-S. UNTIL THEN, SHE'S OPPOSED TO SUCH ACTIONS.

    CRAIG PEACOCK OF FLORIDA AND JARETT CHANDLER OF LOUISIANA WERE ARRESTED AND CHARGED WITH MURDER.

    THE TWO MEN WERE TAKEN INTO CUSTODY AROUND MIDNIGHT AT A CAMPSITE IN OHIO COUNTY.

    BOTH ARE BEING HELD ON A ONE MILLION DOLLAR CASH ONLY BOND IN THE NORTHERN REGIONAL JAIL.

    MORE CHARGES ARE PENDING.

    DOCTOR FERNANDO GONZALES-RAMOS FACES UP TO 5 YEARS IN PRISON WHEN HE'S SENTENCED THIS AFTERNOON.

    GONZALES-RAMOS PLED GUILTY BACK IN APRIL TO CONSPIRACY TO CONTRIBUTE CONTROLLED SUBSTANCES WITHOUT A LEGITIMATE MEDICAL PURPOSE.

    INVESTIGATORS SAID GONZALES-RAMOS' OFFICE IN LOGAN DIDN'T HAVE AN EXAM TABLE, BASIC MEDICAL EQUIPMENT OR RUNNING WATER.

    THE COAST GUARD IS INVESTIGATING WHY A D-C HARBOR POLICE BOAT SPUN AROUND AND HIT AT LEAST 2 OTHER BOATS DOCKED ON THE POTOMAC.

    THE COLLISION PARTIALLY SUNK ONE BOAT, LEAVING IT ON ITS SIDE.

INTRO TEAM ZACH
    WE ARE JUST DAYS AWAY FROM THIS YEAR'S GREAT CHARLESTON HEART WALK.

    THE MONEY RAISED WILL HELP HEART SURVIVORS OF ALL AGES GET BETTER TREATMENT AND INCREASE THEIR QUALITY OF LIFE.

    EYEWITNESS NEWS REPORTER DARRAH WILCOX INTRODUCES US TO ONE OF THOSE SURVIVORS.

    "You expect to take a healthy newborn home. We did not expect to.. we had a healthy normal pregnancy, so it was very shocking."

    Zachary Griffith had a pretty rough start to his little life.

    "We found out Zachary needed heart surgery when he was two days old."

    Shortly after birth, doctors found a valve condition that needed to be fixed immediately.

    "It was explained to us that his valve was closing, so the longer they waited, the more it would close. and eventually it would close so that no blood would be able to pump through his body."

    It was also heart-breaking for Zach's parents.

    "It's pretty tough to see your newborn hooked up to 20, 25 machines that are all vital to his survival."

    But Zach has proven his resiliency over and over. He's had two follow-up surgeries, one at nine months old and another at 18 months old.

    "Since he was 18 months old he's been doing very well. He gets check ups about every six months, and so far, so good."

    And he's the face for this year's Charleston heart walk this Saturday at the Capitol Complex. His family got involved with the American Heart Association when Zach was a toddler.

    "Kids and adults are living much longer with heart problems now because of the things that technology has given us and the heart walk has raised money for."

    They're sharing his story in hopes of raising money and awareness to help kids just like Zach. He'll need one more surgery to replace his aortic valve in the future, and his family hopes research will lead to even better technology by then. For now, Zach continues to be just like any other second grader.

    "We just take it one day at a time. One check up at a time."

NYAD CUBA SWIM
    A LONG-DISTANCE SWIMMER HAS FINALLY ACHIEVED WHAT SHE FIRST SET OUT TO ACCOMPLISH IN 1978 -- SWIMMING FROM HAVANA TO KEY WEST WITHOUT A SHARK CAGE.

    ANDREW SPENCER REPORTS DIANA NYAD WASN'T ABOUT TO LET JELLYFISH STAND IN THE WAY OF HER DREAM

    ENDURANCE SWIMMER DIANA NYAD IS DOING MUCH BETTER SINCE BEING LOADED ONTO AN AMBULANCE, MONDAY AFTERNOON.

    EXHAUSTED, SUNBURNED, AND DEHYDRATED, SHE STRUGGLED TO HER FEET AFTER SWIMMING FROM CUBA TO THE FLORIDA KEYS.

    "With all the experience I have, especially in this ocean, I never knew I would suffer the way I did."

    SHE HAD DREAMED OF THIS DAY SINCE SHE WAS EIGHT YEARS OLD.

    HER FIRST FOUR ATTEMPTS FAILED AS SHE WAS BEATEN DOWN BY ROUGH SEAS, JELLYFISH STINGS, AN ASTHMA ATTACK, AND A LIGHTNING STORM.

    "My whole mantra this year was find a way. You don't like it? It's not doing well? Find a way."

    "We should never ever give up."

    AT ONE POINT, NYAD SAYS SHE HAD SWALLOWED SO MUCH SALT WATER THAT SHE STARTED VOMITING.

    IT TOOK THE 64-YEAR-OLD NEARLY 53 HOURS TO SWIM THE 103 MILES FROM HAVANA TO KEY WEST.

    "It was really rough that first day, Saturday, after the start, and I just said, 'Forget about the surface up.'"

    AT THE END OF HER FIFTH -- AND WHAT WAS TO BE HER FINAL -- ATTEMPT, DIANA NYAD WAS WELCOMED BY A CROWD OF PEOPLE CELEBRATING.

    EVEN THE PRESIDENT'S TWITTER ACCOUNT CONGRATULATED HER FOR BECOMING THE FIRST PERSON TO SWIM THE DISTANCE WITHOUT A PROTECTIVE CAGE.

    "I'm not sure when the next person will do it. That's how hard it is to get everything right."

    IT TOOK A TEAM OF 35 PEOPLE TO GET NYAD TO FLORIDA, INCLUDING DIVERS TO WATCH FOR SHARKS AND GET JELLYFISH OUT OF HER WAY.
