A U.S. ARMY SPOKESMAN SAYS THE SHOOTING SUSPECT IS ALIVE AND WAS NOT KILLED BY AUTHORITIES AS PREVIOUSLY REPORTED. THAT SHOOTER IS IDENTIFIED AS MAJOR MALIK NADAL HASAN, A PSYCHIATRIST, WHO WAS ABOUT TO BE DEPLOYED TO A WAR ZONE -- A DEPLOYMENT HE ALLEGEDLY RESISTED. THE SHOOTING BEGAN AROUND 1:30 P.M. AT THE BASE'S SOLDIER READINESS CENTER. THE ARMY SAYS TWO SOLDIERS TAKEN INTO CUSTODY WERE LATER RELEASED BECAUSE IT WAS DETERMINED THAT THEY WERE NOT INVOLVED.

WHEN THEIR MOTHER WENT INSIDE THE LEE STREET EXXON ONE-STOP-- A MAN JUMPED IN THE CAR AND TRIED TO PUT IT IN GEAR... THAT'S WHEN 9-YEAR-OLD MALIK THOUGHT QUICKLY, AND PULLED THE KEYS OUT OF THE IGNITION! JONATHAN MARTIN IS CHARGED WITH FOUR COUNTS OF KIDNAPPING AND GRAND LARCENY. A MAGISTRATE SET HIS BOND AT 400-THOUSAND DOLLARS.

IT WAS AN EMOTIONAL REMINDER OF THE TRAGIC EVENTS FROM SUNDAY SEPTEMBER 13TH. IF YOU RECALL -- JONES WAS KILLED BY FRIENDLY FIRE AFTER A POLICE CHASE INVOLVING A SUSPECT ENDED TRAGICALLY. THIS IS THE FIRST TIME THE PUBLIC SAFETY COUNCIL HAS GIVEN A POSTHUMOUS AWARD TO AN EMERGENCY WORKER.

EYEWITNESS NEWS REPORTER DARRAH WILCOX HAS MORE ON THE STORY. Two standing ovations... more than a dozen rounds of applause... and a courtroom jam-packed with friends, family and colleagues. That was the reception the Honorable Judge Irene C. Berger received honoring her career and recent appointment. NATS "For a woman who doesn't like a lot of fuss made over her, you all are making a lot of fuss." All jokes aside... Judge Berger says she is appreciated of all the support. "Very honored, and humbled that they would take time from their very busy schedules to be here." The U.S. Senate unanimously approved her appointed as U.S. District judge for the Southern District of West Virginia last month, making her the first African-American federal judge in the state. "I'm very excited about a new challege and trying to continue to do a fair job and to make sure people are heard in a respectful manner." One chapter closed... another just beginning. SEVEN LAWYERS ARE NOW VYING FOR THE SPOT LEFT EMPTY BY JUDGE BERGER'S APPOINTMENT. THEY'VE BEEN APPOINTED BY THE STATE'S JUDICIAL COMMITTEE. GOVERNOR MANCHIN IS EXPECTED TO FILL THAT POSITION SOON.

RICK... WE WANT TO DO A QUICK CATCH UP FOR PEOPLE WHO MISSED PART ONE OF OUR SERIES. THE COUNTRY HAS A DROPOUT PROBLEM AND KANAWHA COUNTY IS RIGHT IN THE MIDDLE. LAST YEAR 555-KIDS DROPED OUT OF LOCAL HIGH SCHOOLS. NO OTHER COUNTY IN THE STATE HAD MORE.. THIS YEAR OUR LOCAL HIGH SCHOOLS HAVE GRADUATION COACHES. RIVERSIDE COACH...FRED MYERS OVERSEES 52 STUDENTS DEEMED AT RISK OF DROPPING OUT. HE SERVES AS A TEACHER, COUNSELOR OR FRIEND...WHATEVER THESE STUDENTS NEED TO KEEP COMING TO CLASS.

THAT'S WHAT TEACHERS ARE DOING TO HELP FIGHT THE DROP OUT RATE. PART OF THIS HELP COMES FROM ALTERNATIVES TO HIGH SCHOOL...FOR INSTANCE HERE AT CARVER CAREER CENTER STUDENTS SPEND HALF THEIR HIGH SCHOOL DAY GETTING HANDS ON TRAINING IN A TRADE TO PUT TO USE RIGHT AFTER GRADUATION. BITE: 11:41:41 ANOTHER ALTERNATIVE HIGH SCHOOL PROGRAM IS AT WEST VIRGINIA STATE UNIVERSITY. IT'S A COLLABORATIVE PROGRAM BETWEEN KANAWHA COUNTY SCHOOLS AND THE UNIVERSITY. SOME KIDS WHO WERE FAILING OUT OF TRADITIONAL HIGH SCHOOL COME TO COLLEGE AND FIND SUCCESS. 18:14:37 HOW WAS HIGH SCHOOL? hated it. 18:16:20 I didn't like all the busy work to pick up time so I didn't do it and I failed the classes. 18:17:00 In that environment if I didn't get out I would have dropped out. NAT: HER ON PHONE PROGRAM DIRECTOR MEG DAVIS SAYS THERE ARE FEWER *TRADITIONAL KIDS IN HIGH SCHOOL NOW AND MANY DROPOUT BECAUSE THEY DON'T FIT THE MOLD, THEY'RE UNCHALLENGED AND UNINTERESTED. 18:04:10 The curriculum may be the problem. AFTER PASSING A PLACEMENT EXAM HIGH SCHOOLERS REGISTER AND ATTEND COLLEGE CLASSES TO FIT THEIR OWN SCHEDULE. NO MORNINGS, NO PROBLEM AS LONG AS THE CLASSES THEY TAKE FILL HIGH SCHOOL GRADUATION REQUIREMENTS. ALONG THE WAY, STUDENTS EARN CREDIT FROM BOTH THE UNIVERSITY AND THEIR HIGH SCHOOL. THE PROGRAM AT WEST VIRGINIA STATE HAS AN 87 PERCENT SUCCESS RATE WITH AT RISK KIDS GOING ON TO HIGHER EDUCATION 18:09:00 I'm doing better in school than I ever have. I guess it's just the pride you get from a high level of learning. NAT: 21 century class file TEACHERS ACROSS THE COUNTRY ARE TRYING TO ADJUST TO THIS NEW GENERATION OF KIDS. ENTER THE 21ST CENTURY CLASSROOM...ANOTHER NEW PROGRAM FOR PUBLIC SCHOOLS. TEACHERS USE TECHNOLOGY LIKE INTERACTIVE WHITE BOARDS AND SMALL GROUP PROJECTS TO PRESENT THEIR LESSONS. HOPING TO PREPARE KIDS FOR THE FUTURE AND KEEP THEM ENGAGED. STATE LEADERS HOPE THIS TOO WILL LOWER THE DROPOUT RATE. THIS PAST SUMMER PEOPLE IN CHARLESTON WERE ABLE TO SEE A VARIETY OF NEW EVENTS. FOR THE NEXT THREE YEARS THE CHARLESTON CONVENTION AND VISIOTRS BUREAU IS ROLLING ALL THREE INTO ONE FOR SPORTSFEST. our goal is to bring people into the community to spend the night shop eat here ALL THREE EVENTS HELPED BRING IN A LITTLE MORE THAN TWO MILLION DOLLARS TO CHARLESTON THIS PAST SUMMER. it was the first year so we have high hopes. 3 year contract for the next 3 years. AND PEOPLE INVOLVED WITH THE VARIOUS SPORTS SAY MAGIC ISLAND, HADDAD RIVERFRONT PARK, AND KANAWHA BOULEVARD ARE PERFECT VENUES. aj: the ampitheater seating look down on river where the track is just a great view for spectators ross: atheltes can get here easy... and the way the city has treated us... the athletes felt welcome SOME PARTICIPANTS IN THE FIREFIGHTER CHALLENGE SAY THEY HAD A GREAT AUDIENCE AND FIREFIGHTERS FROM ALL OVER THE NATION WANTED TO COME BACK. boggess: i believe it's gonna continue growing all the competitiors said ths was the best venue and theyd come back AND BOGGESS SAYS IT'S A GREAT WAY TO SHOW OFF THE CAPITAL CITY. It's the city we serve and protect. why not bring them here? Charleston's a great town. it's a good place to ahve an event like this. SPORTSFEST WILL BEGIN NEXT YEAR AND RUN FROM AUGUST 19-TH THROUGH THE 22ND.

HERE'S PATRICK MCMURTRY WITH THIS WEEK'S BEHIND THE KITCHEN DOOR. We are coming to you this week from the Bridge Road Bistro in South Hills, I'll tell you why in a bit, but we start out at Johnny's Pizza on Route 60 in Barboursville. Inspectors found 9 violations including 5 critical. There was lettuce stored beside raw chicken in the cooler, they had to throw out ham stored at improper temperatures, the hoods were dirty with grease dripping from it, and the vent fan, ceiling, walls, inside of 2 coolers and the make table counter were all dirty. Inspectors said Johnny's corrected all the violations. Up next, the Dragon Bowl at 2700 Dupont Ave. in Belle. Inspectors found 6 violations, including 2 critical. The meat grinder was dirty and the cooking sherry was improperly stored. There wasn't a thermometer in the refrigerator and no lid on the trash can in the women's rest room. Next, O'Charley's at Trace Fork in South Charleston. Inspectors found 5 violations, including 2 critical. There was chicken and rice being stored at improper temperatures-they corrected those problems. They didn't have a thermometer in their refrigerator, either, and there was uncovered containers of food in the cooler. Here's a list of the spots with good reports: the New Dragon Garden in St. Albans and China Super Buffet in Elkview were good, but the La Caretta right next door, and Aladdin's in Kanawha City were perfect. ALL THE FOOD COLLECTED FOR OUR FOOD DRIVE WILL BE USED TO MAKE FOOD BASKETS FOR BOTH THANKSGIVING AND CHRISTMAS AND WILL BE USED TO FEED ROUGHLY 100-THOUSAND PEOPLE HERE IN THE KANAWHA VALLEY AND SOUTHERN WEST VIRGINIA.
