Ohio death row inmate appeals to US Supreme Court

CINCINNATI
Lawyers for an Ohio death row inmate who unsuccessfully argued that he is too fat to die by lethal injection have filed an appeal with the U.S. Supreme Court to halt Tuesday's execution.



The Ohio Public Defender's Office filed the application for a stay of execution Friday on behalf of 41-year-old Richard Cooey. He was convicted of killing two University of Akron students in 1986.

Ohio Gov. Ted Strickland declined clemency to Cooey hours earlier.

Cooey's attorneys argued that prison food and limited opportunities to exercise contributed to a weight problem that would make it difficult for the execution team to find a viable vein for lethal injection.

Cooey is 5 feet, 7 inches tall and weighs 267 pounds.
