Bond Set At $500,000 For Father Charged In Connection With Child's Death

CHARLESTON, W.Va. (Katelyn Sykes, Bob Aaron, Jeff Morris) -- Bond was set at $500,000 for a father accused in connection with the death of his 5-week-old son who was found dead in the backseat of a car.

Robert Jeremy Smith, 33, appeared Thursday in Kanawha County Magistrate Court where a magistrate set his bond. He is charged with child abuse resulting in death in connection to the death of his infant son, Madden.

Charleston police on Wednesday responded to Venable Avenue for reports of a baby that had died in a car. Court records said when Smith exited the car, he said, "The baby is dead. I killed the baby."

Smith claimed he was caring for his son when he heard him crying and when he went to pick him up lost his grip and dropped him, court records said. The complaint said he did not call 911 for 27 hours because he was afraid he would get into trouble.




CHARLESTON, W.Va. (Katelyn Sykes) -- Charleston police said an infant found dead in the backseat of a car in Kanawha City suffered multiple skull fractures.

Robert Jeremy Smith, 33, is charged with child abuse resulting in death in connection to the death of his infant son, Madden, according to his criminal complaint filed in Kanawha County Magistrate Court.

Charleston police on Wednesday responded to Venable Avenue for reports of a baby that had died in a car. Court records said when Smith exited the car, he said, "The baby is dead. I killed the baby."

The complaint said Smith was caring for his 5-week-old son since Sunday at his mother's home on Shank Avenue in Hurricane. Smith said he was watching his son on Tuesday when he heard him crying in a bedroom. He went to pick him off the floor, where he had placed him, lost his grip and dropped him, court records said.

Smith said the baby was gasping for air when he was on the floor. He said he then didn't feel a pulse and wrapped the baby in a blanket but didn't call 911 for help.

The criminal complaint said Smith didn't notify anyone about the baby's death until about 27 hours later. He also admitted to police to shaking his son, but only after police asked him. He said he did not call 911 at the time of the injury because he was afraid he would get into trouble. After the incident and before he eventually called 911, he said he talked to his wife but never told her about what happened to their son.

Smith was lodged Thursday in the South Central Regional Jail.
