Eight Students Facing Expulsion In Calhoun County For Trespassing At Schools

GRANTSVILLE, W.Va. (Leslie Rubin) -- Controversy is swirling in Calhoun County over the potential expulsion of eight high school students. Some say it's a far too severe punishment, while the school system seems to be holding on tight to its power.

"I think it's just ridiculous. They should at least get a second chance," Shauna Yeager said. She is related to the one of the boys involved in the case.

In March, the students, along with a non-student, gained access to Arnoldsburg Elementary and Calhoun County Middle/High School. In one case, one of the boys climbed though an open window and the let the others in, and in the other case, some of the boys reportedly knew the security code to the school.

Three students, who were at least 18, were criminally charged with loitering, but later had those charges dropped. All were suspended for 10 days.

Court documents said some of the students roamed the hallways, others ate snacks from the lunchroom, some played basketball, while another tilted a security camera.

The case moved from the classroom to the courtroom after lawyers for the boys asked for a temporary injunction when they learned the boys were up for expulsion.

The temporary injunction was granted, but in a hearing on Monday, Judge David Nibert ruled the school board can now go forward with those expulsion hearings.

"There was no damage or destruction to any property. They did not cause danger to themselves or any other person. They did not threaten anybody with danger. They didn't put anyone in a reasonable risk of getting endangered," Loren Howley, attorney for several of the boys, said.

The school board will meet on Friday to decide if the students should be suspended.

A lawyer representing Calhoun County schools said he could not comment on the case because he had not been instructed by the board to do so.
