Former Mingo Magistrate Arrested On Cocaine Charge

CHARLESTON, W.Va. (Kallie Cart, Jeff Morris) -- Eyewitness News has learned that a former Mingo County magistrate has been arrested on a cocaine distribution charge.

Dallas Toler was arrested Tuesday morning.

In December, Toler pleaded guilty in federal court in Charleston in an unrelated case. He was accused of illegally registering a felon to vote in the 2012 primary. Following that plea hearing, Toler was released on $10,000 bond on the condition that he would not violate any federal, state or local law while on release, according to a complaint filed in District Court for the Southern District of West Virginia.

The complaint stated that Toler willingly allowed his vehicle to be used for transporting cocaine into the Southern District of West Virginia. Individuals transporting the substance in his vehicle were stopped by the Williamson Police Department on Dec. 31, 2013.

One of the individuals agreed to act as a confidential informant and told officers that he had been buying and selling cocaine and sharing the profits with Toler, according to the complaint. On that same day, the informant placed a call to Toler, and Toler said he needed to get the "coke" out of the defendant's vehicle, which was impounded, the complaint said.

In a recorded encounter between Toler and the informant on Jan. 3, 2014, the complaint said, Toler accepted a payment of $850 from the informant that he believed was from a prior distribution of cocaine on Jan. 10, 2014, Toler also contact the Williamson Police Department to ask whether cocaine was found in his vehicle during the initial traffic stop, according to the complaint.

The U.S. Attorney's Office has asked for a hearing for the court to consider revoking Toler's bond for violations.
