Complaint Filed Against Kanawha Prosecutor, Two Assistants

CHARLESTON, W.Va. (Wes Armstead, Kallie Cart) -- A complaint has been filed against Kanawha Prosecutor Mark Plants and two assistant prosecutors.

Rachael Fletcher, chief lawyer for the the Office of Disciplinary Counsel, said Friday that a complaint has been filed against Plants and Ben Freeman and Adam Campbell, assistant prosecutors.

It was unclear whether the complaints are related to a controversy that is brewing in the office over which some people are claiming there was possible favoritism going on between Plants and his former secretary, who is now his wife.

Over a four year period--- from 2009-2013 -- Sarah Foster worked for Plants. During that time, her salary rose from $23,000 to more than $43,000. Also raising eyebrows, the fact that some tickets Foster got for an expired inspection sticker were dismissed and signed off on by the prosecutor's office, without any proof that foster had remedied the situation. At the time, Foster was married to a Charleston detective.

On Thursday, Eyewitness News spoke with Plants on camera. He said while Foster did indeed get raises, so did other people in his office, and Foster's position had changed, and it was a promotion that warranted a raise.

Plants would not answer any questions about his personal relationship with Foster. The two got married last month in Boyd County, Ky. Her brother was hired as her replacement.
