Police Release Surveillance Video Of Fight That Led To New Year's Day Shooting

CHARLESTON, W.Va. (Leslie Rubin) -- Police have released surveillance video of the New Year’s Day downtown fight that led to a shooting in the capital city.

The shooting happened in the Virginia Street entrance way for the Recovery Sports Grill and the Ramada Inn. The fight was said to be sparked by a misunderstanding about a pizza delivery number.

Charles Scott, 23, of Charleston was wounded in that incident.

Attorney Jamison Conrad is now facing an accessory charge for what police said he did after the shot was fired. Conrad is in trouble, because police said he can clearly be seen on surveillance video taking Underwood's cell phone, which is considered evidence, from the scene and telling the suspect to run.

Underwood's cell phone was found in Conrad's hotel room after the shooting. Police say Conrad told them he was not going to tell them who the shooter was because he was a "dear friend."

Michael Underwood, 30, of Beckley was charged with malicious wounding. He turned himself in the next day.

Underwood did have a valid conceal carry permit, according to Charleston police.

Recovery had been closed for several hours prior to the shooting.

Meanwhile, the troubles continue to mount for Conrad. In addition to being an attorney, he is also an appointed Mental Hygiene Commissioner in Fayette County.

Eyewitness News has learned the chief judge in the county has now suspended Conrad from that position.

Commissioners are paid by the case, so Conrad will not be compensated during his suspension.

There has also been a complaint filed against Conrad with the W.Va. Office of Disciplinary Counsel.

Charleston Mayor Danny Jones had said he was going to file an ethics complaint if the case wasn't investigated, but indicated Friday that he didn't believe that was going to be necessary because one has already been launched.

Conrad practices law in Fayetteville with his father, Erwin Conrad, at their firm, Conrad and Conrad.

Conrad was arraigned Thursday behind closed doors on a single felony count of accessory after the fact to malicious wounding.

He posted bond, and was released from custody.

"We want action taken against an officer of the court that conducts himself in that way in our town. If you want to conduct yourself that way in Fayette County or Fayetteville, that's your business, but Charleston, West Virginia, that's our business," said Mayor Danny Jones on Friday.

The West Virginia Supreme Court Administration has also filed an extraordinary complaint with the Judicial Investigation Commission because of Conrad's position as a mental health commissioner.

Charleston Police are hoping more witnesses will come forward with information that will assist in their investigation.
