LOGAN, W.Va. (Mamie Buoy) - An alleged home invasion suspect who was shot while trying to break into a home in Logan has been arrested.
Jimmy Walker was arrested Saturday night after being released from the hospital.
Terry Robbins says Walker and Justin Blair broke into a home he was watching for some friends last weekend. Robbins says there was a struggle with Walker, and to defend himself, he had to fire his gun.
After he was shot, Walker crawled down the street to his father's house.
When police arrived, we are told Blair busted out of the window of the cruiser and took off. He was arrested after troopers found him hiding at Clint Toler's house. Toler was also arrested.
Walker is charged with burglary and conspiracy.
Blair is charged with nighttime burglary, battery on a police officer without a weapon, obstruction, destruction of property, possession of a controlled substance, escape from custody and a probation violation.
Police in Logan County were investigating an alleged home invasion which left a man critically injured Saturday.
A housesitter in Christian was alerted of a possible break-in through the home's alarm system, and he allegedly caught the two men trying to break into his house.
There was a struggle, and he pulled out a gun, shooting and seriously injuring one of the suspects.
The other took off on foot and was later arrested.
The man who fired the gun is not being charged.
Eyewitness News spoke with the shooter and the suspect's family about what happened.
Saturday morning was life-changing for Terry Robbins -a moment, in slow motion, he will never able to forget.
"You see the smoke,” he said. “You hear the bang, the flash. You can almost see the bullet going."
Robbins said he had no other choice than to protect himself. After State Police said Jimmy Walker and Justin Blair broke into this home on Harmony Drive in Christian.
Robbins doesn't live at the home, but the homeowners who are out of town received a call from the alarm company and asked him to go and check things out.
He said he caught the would-be crooks red handed.
"I told them, ‘Freeze! Hit the floor! I will shoot you!’ " he said.
That's when Robbins said there was a struggle with Walker and, to defend himself, he had to fire his gun.
When he left to call police, Walker's accomplice, Justin Blair took off and Walker crawled down the street to his father’s house.
Walker's father said this robbery was fueled by a drug addiction.
He said, unfortunately, he saw something like this coming, but that doesn't make it any easier.
"Its rough seeing him over there with his guts shot up," he said.
Walker remains in the intensive care unit of a Charleston area hospital.
Robbins has a concealed carry permit and detectives are not pressing charges.
Police said the second suspect, Justin Blair, busted out the window of a police cruiser, and took off.
Troopers said they found him hiding in his relative, Clint Toler's home.
They said Toler was helping Blair to try and get his handcuffs off.
Blair was taken into custody as well.
One man was hospitalized, and another taken to jail after an attempted home invasion in southern Logan County Saturday morning.
Troopers said two men tried to break into a house along Harmon Drive in Christian, just north of the Mingo County line.
Police said a person living there caught them red-handed, and shot Jimmy Walker, one of the alleged intruders.
The other suspect, Justin Blair, took off on foot and was later arrested.
At last check, Walker was in critical condition.
No charges are expected against the resident who fired his gun.
And no word was available on what charges the two suspects are facing.
