Washington, D.C. , West Virginia

West Virginia’s three members in the U.S. House of Representatives voted Friday with the Republican majority to support a plan that permits health insurance companies to continue selling policies that do not comply with the new federal health care law.

A group of 39 Democrats defected to vote with the Republicans.

Republican U.S. Reps. Shelley Moore Capito and David McKinley and Democrat U.S. Rep. Nick Rahall were among the representatives who voted in support of the “Keep Your Health Plan Act,” according to House vote totals. Republicans Bill Johnson of Ohio and Hal Rogers of Kentucky voted in favor of the measure. Four Republicans voted no, including Thomas Massie of Kentucky.

The Washington Post reported the proposal would allow more Americans to keep their current health plans while significantly weakening part of the Affordable Care Act. Under the proposal by Rep. Fred Upton, R-Mich., insurance companies would be allowed to keep selling health policies that do not reflect the Affordable Care Act’s consumer protections.

The House passed to bill in a 261 to 157 vote.

On Thursday, President Barack Obama had proposed his own fix – to allow insurers and state insurance commissioners to extend those policies through most of 2014. But the House version takes it a step further.

The Post said the House-passed bill faces tough sledding in the Senate. Obama also has vowed to veto it.
