Hospital's Request For Restraining Order Against Environmental Group Denied

A Cabell County circuit judge has denied a local hospital's request for a temporary restraining order against an environmental group.

St. Mary's Medical Center asked Judge Paul Farrell for the injunction against the Ohio Valley Environmental Coalition, which has planned a rally against a speaker at an event at one of the hospital's facilities Tuesday.

The Huntington Area Chamber of Commerce is hosting the ninth annual Energy & Natural Resource Symposium at the St. Mary's Center for Education on Fifth Avenue Tuesday. The featured speaker is Robert M. "Mike" Duncan, president and chief executive officer for the American Coalition for Clean Coal Electricity.

The environmental group's members said they are hosting the rally near the education center late this afternoon in opposition of St. Mary's "hosting a 'clean coal' promoter."

A representative for St. Mary's Medical Center said it often let groups use or rent the education center for conferences, and the hospital is not promoting any particular cause.

The hospital said it is concerned about protesters disrupting patient care and students attending classes at the center. Representatives for the environmental group said the rally was planned on public property outside the fence line of the education center.

Farrell denied the request for the temporary restraining order, and said the hospital should call police if the rally moved on to its private property.
