Fayette County deputies said a man faces 17 counts of sexual abuse by a parent, guardian or custodian after he was accused of having sex with a female juvenile.
Brian D. Hawver, 39, of Victor was arrested Monday for alleged incidents that were reported to have occurred between June 2003 and July 2004, according to a Fayette County Magistrate Court Complaint.
Several people came to the Oak Hill in July 2004 to file a complaint against Hawver, claiming he had sex with the girl. At the time, Hawver told an investigator while he had discussed things of a sexual nature with the girl, they were just friends and the girl denied that she had a sexual relationship with Hawver, the complaint said. As a result, the investigation was closed.
In November 2012, a new complaint surfaced against Hawver that he had molested another girl and a Fayette County grand jury indicted him on 10 counts of sexual abuse by a parent, guardian or custodian and 10 counts of first-degree sexual abuse. Assistant Fayette County Prosecuting Attorney Brian Parsons filed a motion to introduce evidence that Hawver had engaged in prior criminal conduct of a similar nature.
As a result, the juvenile in the 2004 case who had previously denied the sexual allegations testified at a hearing that she had Hawver and indeed had sex, the complaint said.
Hawver was being held in the Southern Regional Jail.
