The Lawrence County Sheriff's Department released the name of the man who was shot by a homeowner Wednesday morning.
Brandon Blaike Danner, 18, of Coal Grove was shot four times and is recovering in the hospital. Danner will be charged with breaking and entering and could face additional charges, deputies said.
The homeowner is not facing any charges at this time and claims the shooting was in self-defense. The Sheriff's department said the homeowner also fears retaliation.
Kathy Hapney owns a Barber Shop just down the street and says, "I'm a firm believer in protecting your property and protecting yourself."
Police say Danner lost a lot blood and one of the bullets punctured his lung. He remains in Cabell Huntington Hospital.
Mary Friend also lives in the neighborhood where police say there have been several reports of prowlers. "To be honest, I'd do the same thing, you don't go around people's houses at night or early morning to get their stuff. You just don't do that."
The incident happened about 6 a.m. Wednesday at a home in the 600 block of Center Street in Coal Grove. Deputies said the homeowner told them he saw the suspect in his storage building and confronted him. The homeowner said the suspect lunged at him and he shot him.
Police are still investigating the shooting. The results will go to the prosecutor.
This case brings to mind the Castle Law, which gives residents in 30 states the right to use deadly force if their lives are in danger.
In West Virginia and Ohio, both laws appear to operate the same. It says an occupant in a home or place of residence is justified in using reasonable force against an intruder or attacker to prevent entry into a home, to apprehend the intruder, to prevent the intruder from causing harm or if the occupant believes the intruder intends to commit a felony in the home the occupant does not have to retreat from the intruder. Also, offenders cannot recover any damages or bring any civil action against the victim while engaging in criminal conduct.
Police are investigating a shooting that happened in Coal Grove early Wednesday morning in which a homeowner said he shot a prowler.
The Lawrence County Sheriff's Department and the Coal Grove Police Department are investigating after a homeowner in the 600 block of Washington Street in Coal Grove reported that a man was breaking into his storage building around 6 a.m. Wednesday. Police had already received reports of a prowler around houses in the area.
Police said that when they arrived, it appeared the homeowner had just shot the suspect. The suspect was taken to Cabell Huntington Hospital and underwent surgery for gunshot wounds.
The homeowner told police he heard someone breaking into his storage building and found the suspect had taken a motorcycle. Police said the homeowner was armed with a handgun and confronted the suspect. The homeowner said the man said he had a knife, became aggressive and lunged at him. The homeowner said he then shot the suspect several times in his upper torso, police said.
The names of the suspect and homeowner have not been released. The investigation is ongoing.
