Mingo County commissioners have appointed an assistant Mingo County prosecutor as the temporary prosecutor to fill the post left vacant when Michael Sparks resigned.
Teresa Maynard, who has been an assistant prosecutor since 2005 and served under Sparks, was selected by commissioners on Thursday as the temporary prosecutor. She will serve no longer than 30 days.
The position was left vacant when Sparks resigned Thursday from his job. On Wednesday, he was charged in a federal information that accuses him of participating in a scheme to block accused drug dealer George White of the counsel of his choice. Sparks also has been fighting attempt to suspend his law license.
Commissioners will take applications for the prosecutor position until the close of business, Friday, Nov. 1, for anyone interested in filling the remainder of the term. Commissioner Greg "Hootie" Smith said they wanted an assistant state attorney general to fill the post, but there were some legal hurdles. The commissioners are consulting with the state Attorney General's Office and the West Virginia Prosecuting Attorneys Institute on the best way to proceed in selecting someone to serve out the remainder of the term.
Meanwhile, the Office of Disciplinary Counsel said there are no current or pending actions against Maynard. She said she was aware that Sparks was talking to federal officials, but she did not know what the conversations were about.
