The legal fight for same-sex marriage on the federal level began Tuesday in West Virginia.
Lambda Legal filed the lawsuit in U.S. District Court for the Southern District of West Virginia in Huntington Tuesday morning, on behalf of three same-sex couples who want to marry.
The couples are Casie McGee and Sarah Adkins, Justin Murdock and Will Glavaris, all of Huntington. Nancy Michael and Jane Fenton of St. Albans are also parties in the suit.
Fenton and Michael are raising their son Drew.
"It's so important, but we have to do it," Fenton said. "We have to take this step. We weren't going to bring Drew, but we chose to bring him. Not only is it of great importance to us, but most importantly it impacts his future."
"We want to be married because that's what our relationship is," Justin Murdock said. "You know it's just annoying when people you meet for the first time and you're trying to introduce each other and you think what do I introduce him as, a partner? No, we're not in business together. Do I introduce him as my boyfriend? No we're more than that. I want to introduce him as my husband."
"The basis of the lawsuit is simple," Beth Littrell with Lambda Legal says. "Under the U.S. constitution, the government cannot treat it's citizens differently or discriminate unless it has a sufficient reason. Our lawsuit alleges and will be able to prove, there is no sufficient basis to deny same-sex couples access to marriage."
West Virginia is still one of several states where same-sex marriage is illegal. Since the Defense Of Marriage Act was struck down by the U.S. Supreme Court this summer, it has opened the doors to similar lawsuits across the country in states where same-sex marriage is still illegal.
