The trial of of a man accused of neglect in the death of a child with a disability began Tuesday in Cabell County Circuit Court.
Delmond R. Dennis Jr. is charged with felony neglect charges in connection with the death of Jordan Moore, a 6-year-old who had cerebral palsy and autism. Jury selection started about 9:30 a.m. in the trial.
The indictment states Dennis neglected the child by not taking him to the hospital to be examined or receive medical care after the child fell down stairs and hit his head back in 2009.
Opening arguments began after jury selection. Assistant Prosecutor Kelly Neal told the jury, "This child did not fall two or three steps to a landing on a stairwell. You'll hear this child was a victim of child abuse. You'll hear his death resulted from child abuse from this intentional traumatic blow to the head that caused an internal injury that ended up killing him."
Defense attorney Courtenay Craig says Jordan fell a lot because of his delay in reflexes and there's no way the prosecution can prove Dennis is responsible for the child's death or bruises found on his body.
Craig said, "They're not going to be able to show or tell you my client did a single thing to that child but be there at the same time when one injury occurred. That isn't evidence that my client intentionally and maliciously tried to hurt this child. That's no proof he did that."
Jordan's step-mother says the family just wants justice to prevail. Trish Moore said, "We're finally going to get some closure for Jordan and some justice I hope."
The trial will continue Wednesday morning at nine o'clock.
