The Kanawha County Parks and Recreation Committee discussed whether a civil lawsuit is possible over timbering at Coonskin Park, but agreed they still must gather more information before deciding what action to take.
In July, the conflict over the trees removed from Coonskin Park was resolved. David Bowen's company, Russell Trucking, was accused of cutting down healthy trees for a profit. The West Virginia Division of Forestry issued a release order in July saying Bowen's company was in compliance in regards to land reclamation.
At Wednesday's meeting, committee members said they are waiting to get the survey back on the trees Bowen's accused of cutting down. They want fair market value of those trees and after they have that report, they said they can move forward.
The committee also talked about Bowen's company repaving the road the committee believes he tore up.
The lawyer for the parks commission said a future lawsuit against Bowen's company isn't out of the question.
"We would like to resolve this matter quickly so the park can move on with its business," said Chuck Bailey, lawyer for the Kanawha County Parks Committee. "I'm hoping that will occur, but as I said before, I must be satisfied, this board must be satisfied at least that the repair of the roads are made with what we want. Once that is done satisfactorily, then we can discuss it."
Bailey said the board would rather move forward and resolve the matter than file a civil suit. Bailey also said the Kanawha County Sheriff's Office is conducting a criminal investigation into this matter, but he said it's somewhat unrelated. He declined to elaborate.
