A race car driver following in the footsteps of some famous family members was arrested overnight on a drunken driving charge and is out of jail.
Bobby Dale Earnhardt appeared before a magistrate judge Tuesday morning. He was released from the South Central Regional Jail shortly later on a personal recognizance bond.
Earnhardt was arrested late Monday night after Charleston police said he was driving erratically on the city's West Side. When police pulled him over, they said, his eyes were glassy and his speech was slurred. They also said they could smell alcohol coming from the car.
Earnhardt admitted to officers to taking two shots at a West Side bar, police said.
Police said he failed a field sobriety test. He was arrested and taken to the police station. At the station,police ran an intoximeter that showed his blood alcohol level to be 0.193. The legal limit in West Virginia is 0.08.
When he was released from jail, he didn't say anything to Eyewitness News, but a woman who picked him up said he is deeply saddened by what happened and they are glad no one was injured. Earnhardt was visibly upset by what happened.
People who know him said they are shocked by his arrest.
"He's a very nice young man," said Carolyn Smith, a friend. "He hasn't even been drinking. Very, very polite. You wouldn't want anyone any better than him. I'm shocked at it. Everybody makes mistakes. He's not the first, and I'm sure he's not going to be the last and don't judge him from that."
Earnhardt is the grandson of the late Dale Earnhardt.

Bobby Dale Earnhardt was charged with aggravated DUI.
Charleston police said they heard tires squealing about 11:40 p.m. Monday on Washington Street on the city's West Side. They said they saw a car driving fast and making turns too wide. Charleston police were able to pull the car over and said Earnhardt failed a field sobriety test. He was arrested at the scene.
Earnhardt was being held in the South Central Regional Jail awaiting arraignment.
Aggravated DUI is a misdemeanor. Aggravated DUI means a person's blood alcohol is above 0.15. Police didn't indicate what Earnhardt's blood alcohol level was.
Earnhardt is currently driving in the ARCO Truck Series. According to his Facebook page, he was supposed to have an autograph session on Tuesday in Beckley at the Habitat for Humanity.
