A man who was put in jail for more than a year because of a failed drug test will now be allowed to serve his original sentence of two to 10 years on home confinement.
Kanawha Circuit Judge Duke Bloom decided Wednesday that James Miller could now serve his home confinement sentence. In March 2012, Miller pleaded guilty to felony driving under the influence causing death. He was sent to jail later, however, because of the failed drug test.
Miller was driving his car with three other passengers when he crashed in Big Chimney in February 2011. Brandon Bradshaw, 23, one of Miller's best friends, died in the wreck, At the time, Bradshaw's mother urged the judge not to send Miller to prison, saying the all the families involved have suffered enough from this tragedy.
