"He's at the doctor a lot," Gray said. "He's been to Cabell E-R more than I can count."
The Wayne County board of education pressed criminal truancy charges against her after her son missed at least 20 days of schools.
Gray says while she may have not submitted the paper work correctly, she requested a jury trial because she says there are documented doctor excuses.
Gray also says the school misinterpreted dates.
Wayne County assistant prosecutor Sean Maynard says the verdict came back as an undecided jury.
"Kids are required to be in school unless there is just cause, and that's what the jury got hung up on," Maynard said.
