A Kanawha Circuit judge ruled that two former tenants of a roach-infested apartment building in Charleston that was shut down by city inspections will not have to pay rent. Judge Charlie King's decision on Monday overturns a Kanawha County Magistrate Court ruling that required former tenants Candiselee McKean and Brandon Lester to each pay $1,050. King said Family Homes & Rental Inc. is not entitled to rent for "property that has been declared unfit and unsafe." Earlier this month, the landlord of the property, Timothy Stone, was arrested after he allegedly pulled out a screwdriver and attempted to hurt a Charleston police office, during his arrest. Building inspectors for the city of Charleston deemed Stone's apartment rooming house at 1411 Jackson St. unfit for human occupation. Fifteen people now have to find other places to live. A Charleston landlord whose roach-infested apartment building was shut down by city inspections last week appeared in Kanawha County Circuit Court Thursday. Timothy Stone was arrested after he allegedly pulled out a screwdriver and attempted to hurt a Charleston police officer, during his arrest last week. During Stone's appearance in court, tenants tried to get out of paying back rent judgment ordered by a magistrate. Building inspectors for the city of Charleston deemed his apartment rooming house at 1411 Jackson St. unfit for human occupation. Fifteen people now have to find other places to live.
