A man accused of shaking a baby that died has a trial date set.
Michael Fannin of Huntington was charged with child neglect resulting in death. In April 2011, troopers said Fannin shook a 4-month old baby girl who then suffered from severe brain swelling. The baby later died at the hospital.
Fannin's trial is set for Jan. 15, 2013. Fannin is out on bond.
A four-month-old baby, dead at the hands of her babysitter. That's what state police say happened this weekend at a home in Marcum Terrace in Huntington. They arrested Michael Fannin for child abuse by a parent, guardian or custodian resulting in death.
Fannin tells troopers and Eyewitness News that it was just an accident. He told troopers he was holding the baby when a screen door slammed, startling them both. He says the baby girl "flipped over" onto the couch. Then he says she fell on her head on a concrete floor. Trooper say the injuries she sustained do not coincide with either explanation. The baby was taken to the PICU at Cabell Huntington Hospital and died Monday afternoon. Doctors say the cause was a severe case of "shake and slam" or "shaken baby".
Fannin was arraigned in front of magistrate Patty Verbage Spence this afternoon. She set his bail at one million dollars cash-only. He's at the Western Regional Jail and is scheduled to be back in court May 13th.
