Kanawha Circuit Judge Charlie King dismissed a civil suit Thursday by Ex-Mason County Deputy Eric Lynch against Mason County.
The judge ruled it was the improper revenue for the case. Lynch will be able to refile the case in Mason County.
Lynch claims he was wrongfully terminated in 2010, but the county sheriff’s office said Lynch resigned just before he was indicted. He pleaded guilty to one count of fraudulent schemes over the misuse of his department-issued gas card. Due to the guilty plea, his law enforcement certification was revoked.
