Mingo County Sheriff's tell Eyewitness News that Wendell Lewis Perry was driving his car eratically on State Route 3-5 in the Breenden area when his car and a school bus collided yesterday evening.
Randolph Maynard, a passenger in the car with Perry was killed in the wreck while the bus driver, Ron Joplin refused treatment from emergency crews.
During the investigation of the crash, Deputies say they found several cans of alcohol and several pill bottles in the car.
Wendell Perry was taken to the hospital and deputies say that when he is released he will be charged with DUI causing death.
