MINE PERMIT LAWSUIT Judge Rules Against EPA's WV Mine Permit Challenge

A federal judge has ruled against environmentalists in their challenge to a Clean Water Act permit for a Logan County coal mine.
U.S. District Judge Robert Chambers ruled in favor of the U.S. Army Corps of Engineers and Alpha Natural Resources.
The Ohio Valley Environmental Coalition and other groups had challenged the permit at Virginia-based Alpha's Highland Reylas surface mine, which would bury about 2 1/2 miles of streams.
During earlier testimony, scientists testified that the corps, in approving the permit, ignored scientific studies that have documented harm to headwater streams from mountaintop removal operations.
