Kanawha County Chief Deputy John Rutherford is resigning his post.
Rutherford resigned as a precaution because he is running for Kanawha County Sheriff.
According to the Federal Hatch Act; federal, state and local employees who are paid with federal funds or who oversee federally funded programs can not participate in a partisan election.
