The West Virginia State Supreme Court will decide what to do with the Sheriff of Mason County .
The county commission filed a 20-page petition Monday in Mason County Circuit Court.
That petition lists, quote: "illegal and immoral activity that has resulted in a 42 count indictment against Sheriff David Anthony."
Anthony is charged with several felonies and misdemeanors ranging from wanton endangerment to embezzlement.
The petition now goes to the supreme court where a three-judge panel will review it.
Sheriff Anthony released this response saying: "I assumed the commission intended to file the petition. I haven't seen it, so i can't comment on the petition itself. As far as the charges, I maintain my innocence and the truth will come out in court."
