The battle over mountaintop removal rages on.
The mine surface board heard from environmentalists and a coal company about plans for Coal River Mountain.
Massey Energy was granted a permit more than two years ago by the Department of Environmental Protection allowing them to mine the surface of the Coal River Mountain.
Many people living near the site want the permit revoked and the mountain to be used as a wind farm instead.
Massey is seeking a revision to the permit, which is why opponents are trying to stop surface mining at Bee Tree mine before it starts.
The hearing could last another day before the board makes a decision.
Meanwhile, a well-known environmentalist Mike Roselle has moved to West Virginia taking up this cause.
Roselle has been called an "eco-terrorist" by some because of his tactics.
