John McCallister says his three year old daughter is doing better than she was a few weeks ago.

McCallister says, "She's doing great. Better. She's not cold and dirty anymore."

Police say the day after Christmas they received a tip that a little girl was walking along on the side of Route 34 in Hurricane.

Officer J.M. Kerr says, "When we arrived the little girl was wearing nothing but a pair of underwear and that's it. Cold and shivering."

The mother's live-in boyfriend, Eric Bailey says he and Dowdy were out of the room less than a minute and when they walked back in the little girl had apparently walked out the front door.

The child wasn't that far from her home in Hurricane but she was on one of the busiest streets in town by Hurricane Middle School.

Bailey says he and the little girl's mother, April Dowdy, have always taken good care of the child but the girl's father says there have been problems in the past.

But Bailey says the children's father has never shown an interest in the children until now.

McCallister says, "I've wanted custody. As of right now I have emergency temporary custody. That's what I wanted was custody of my kids."
