A cross lanes man has now been charged along with his wife in the death of his 22-month-old son.
A Kanawha County jury has indicted Christopher Washburn, 31, for child neglect causing a death.
The child's mother Elizabeth Thorton, 21, of Cross Lanes had already been arrested on the same charge. She was also indicted by the grand jury.
Prosecutors contend they both failed to get medical help for the child.
They are scheduled to be arraigned on October 10th.
