The case against two army deserters charged with murdering a Huntington pastor is going to the grand jury. The crime which happened on federal property could lead to a federal death penalty case.
Police allege Daniel Smith confessed and named Stephen Wilson as the triggerman.
Both men are charged with murdering Rev. Mark McCalla.
His body was found June 19th at a Beech Fork Wildlife Management Area shooting range.
An ATF agent that captured Smith testified that Smith confessed, naming Wilson as the triggerman. Smith says they went to the range to steal guns. The victim's two rifles were believed sold in Newport News, Virginia.
One of the handguns that belonged to McCalla was found in Wilson's bag on the bus.
The violent crime on federal property has raised the possibility of pursuing a federal death penalty case.
Wayne County Magistrate, Teddy Mays, found probable cause Wednesday to send the case to the Wayne Grand Jury.
The two men continue to be held without bond in the Western Regional Jail.
