The family of the woman hit by a car in the parking lot of a local grocery store is upset over an apparent legal loophole that let the driver walk away from the scene.

Greg Cunningham hoping his wife Deborah will make a full recovery after being hit by a car. She was struck Tuesday night in the parking lot of the Foodland Grocery Store on Spring Street. The driver, Leontine Braxton did not have a drivers license or insurance, but police could not cite Braxton for breaking those traffic laws.

Police say the investigation is still ongoing and the charges they can file under the law, either reckless driving or negilgent homicide depends on if Cunningham makes a full recovery. Cunningham is under evaluation in the ICU at CAMC General.
