A nurse convicted of murdering her husband is appealing to a higher court. Michelle Michael is serving a life sentence for fatally drugging her husband, James. She is also serving 20 years for burning their home.
Michael's lawyer filed a notice Thursday of her intent to appeal the Monongalia County Circuit Court's denial of post-trial motions and her conviction by a Kanawha County jury. The documents are now being forwarded to the state Supreme Court.
Prosecutors said the November 2005 murder was committed for the victim's $500,000 life insurance policy.
The jury granted mercy in the murder conviction, so Michael might be eligible for parole after 20 years.
